Does it work if they don't have my contact saved?

Yes. wa.me/<number> opens the chat without needing the contact saved first. It's the method WhatsApp officially recommends.

What if they don't use WhatsApp?

They see a WhatsApp message saying that number doesn't use the service. You don't get notified.

Is there a message length limit?

WhatsApp allows up to 65,536 characters in the URL, but for browser compatibility stay under ~2,000 — that's already a lot.

Why wa.me and not api.whatsapp.com?

wa.me is WhatsApp's official short domain, redirects to the same target, and is much cleaner — especially for QRs (fewer characters = simpler code).
